Terms of service
These are the rules for using MarkBlue, run by [LEGAL ENTITY NAME]. They are written to be read once and understood, not skimmed past. If a term below does not work for how your crew operates, email us before you reserve a spot rather than after.
What MarkBlue does
MarkBlue turns a walkthrough into a punch list. You record audio while you walk, flag items as you go, and we transcribe what you said into written items with snapshots, a trade, a priority, and a due date. Each job gets one live link you can hand to your subs.
The product is still being built out with a founding group of Florida crews. Features described on the marketing pages are what we are building toward, not a guarantee of what exists on any given day.
Who can use it
You need to be at least 18 and able to enter a contract. If you are signing up for a company, you are telling us you have authority to bind that company to these terms.
Keep your login to yourself. Anything done from your account is treated as done by you, so if you think someone else is in it, tell us immediately.
The founding rate
The founding rate is $79 per month per account. It is locked for the life of the account — if we raise prices later, yours does not move, as long as the subscription stays active.
After the first charge, it renews monthly on the same date until you cancel. Cancel any time and you keep access through the period you already paid for. We do not prorate partial months, and we do not charge a cancellation fee.
If a payment fails, Stripe retries it. If it keeps failing we may suspend the account until it clears. Your data is not deleted during a suspension.
Recording on the jobsite
MarkBlue records audio. That is the entire point of it, and it is also the part that carries real legal weight, because other people are usually standing there while you do it.
You agree not to use MarkBlue to record anyone who has not agreed to it, and not to record conversations that have nothing to do with the work. If a recording lands you in a dispute, that is between you and the other party — we are not a witness and we do not take sides.
Your content
Your recordings, transcripts, photos, and punch lists are yours. We do not sell them, we do not use them to train models for anyone else, and we do not hand them to third parties except the vendors that make the product run.
We do need your permission to operate: to store your files, transcribe your audio, resize your photos, and show all of it to the people you share a link with. That permission exists so the software can work, and it ends when you delete the content or close the account.
You are responsible for what you upload. Do not put anything in MarkBlue that you do not have the right to store or share.
Shared links
Job links work without a login. That is deliberate — subs will not install an app or remember a password, and pretending otherwise is why punch lists rot in email.
What MarkBlue isn't
It is a field tool, not a system of record. It is not a substitute for your contract documents, your daily reports, your insurance file, or legal advice. If a job goes to a claim or to court, do not assume a MarkBlue export is sufficient evidence on its own.
Transcription is machine transcription. It gets trade jargon wrong, especially on a loud site. Read your items before you send them to a sub — the written item is what your crew acts on, so it is on you to check it.
Availability
We aim to keep MarkBlue up and we will tell you about planned downtime, but we do not offer an uptime guarantee at the founding rate. Plan for the possibility that you cannot reach it from a site with bad signal.
We may change or remove features while we build. If we remove something you rely on, we will give you notice by email first.
Ending your account
You can cancel whenever you want. Ask us to delete your data and we will, within 30 days, except where we are required to keep billing records.
We can suspend or close an account that is being used to break the law, to record people without consent, or to attack the service. If we do that outside of those reasons, we refund the unused portion of your month.
If something goes wrong
MarkBlue is provided as it is. We do not promise it will be error-free or that transcription will be accurate.
To the extent the law allows, we are not liable for lost profits, lost jobs, delayed closeout, or missed payments, and our total liability to you is capped at what you paid us in the twelve months before the claim. Some states do not allow those limits, in which case they apply as far as they legally can.
Disputes
These terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. Disputes go to the state or federal courts located in Florida, and we both agree to that.
Before filing anything, email us. Most problems are a misunderstanding about billing and take one message to fix.
Changes to these terms
If we change these terms in a way that matters, we will email account holders and update the date at the top of this page. Continuing to use MarkBlue after that means you accept the new version. If you do not, cancel and we will refund the unused part of your month.
